Terms of Service

1. ACCEPTANCE OF TERMS

By accessing and using the SAFE mobile application, website, and services (collectively, the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") constitute a legally binding agreement between you and SAFE, SC Innovations ("SAFE," "we," "us," or "our") regarding your use of the Service.

2. DESCRIPTION OF SERVICE

SAFE is a security and health assistant service that provides:

• Emergency SOS alerts and real-time location sharing
• AI-powered health assistant for general health questions and guidance
• Community safety alerts and incident reporting
• Secure communication with emergency contacts
• Safety planning and check-in features

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

3. USER ACCOUNTS

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information about yourself
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. SUBSCRIPTIONS

Some features of the Service may require a paid subscription. By purchasing a subscription, you agree to:

• Pay all charges associated with your subscription at the prices in effect when such charges are incurred
• Provide a valid payment method for your subscription
• Authorize us to charge your payment method for all subscription fees

5. CANCELLING SUBSCRIPTION

You may cancel your subscription at any time through your account settings or by contacting us at support@safercity.io. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will continue to have access to premium features until the subscription expires
• No refunds will be provided for the current billing period unless required by law
• Your account will revert to free tier features after the subscription expires

6. USER CONDUCT

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use the Service for any commercial purpose without our express written consent

7. MEDICAL DISCLAIMER

In case of a medical emergency, contact your local emergency services immediately. Do not rely on the Service for emergency medical situations.

8. EMERGENCY SERVICES

The SOS and emergency alert features are designed to help you contact your emergency contacts and share your location. However:

• SAFE does not guarantee that emergency services will receive or respond to your alerts
• The Service is not a replacement for calling emergency services directly
• Always call your local emergency number (e.g., 911, 112) in case of a life-threatening emergency
• SAFE is not responsible for the response time or actions of emergency services or your emergency contacts

9. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are owned by SAFE and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of third parties on the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless SAFE and its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Service or your breach of these Terms.

12. TERMINATION

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

13. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. GOVERNING LAW

These Terms shall be interpreted and governed by the laws of the jurisdiction in which SAFE operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
